Terms of Service

These Terms of Service govern access to and use of Dragonfly, including https://dragonflyapp.com, waitlist features, contact forms, accounts, checkout, dashboards, and any related services we provide.

By using the service, creating an account, joining the waitlist, submitting a form, or purchasing a plan, you agree to these Terms. If you use the service on behalf of a company or organisation, you confirm that you have authority to bind that organisation.

The service

Dragonfly App is software intended to help print and production teams organise operational workflows, communication, schedules, and related business information. Some features may be in private beta, early access, preview, or waitlist stage and may change before general availability.

Eligibility and accounts

You must be at least 16 years old, or the minimum age required in your country to use online services, and legally able to enter into these Terms. You are responsible for keeping account credentials confidential and for activity under your account.

You must provide accurate information and keep it up to date. We may suspend or terminate access if information is false, security is at risk, payment fails, or these Terms are breached.

Acceptable use

You must not misuse the service. This includes attempting unauthorised access, interfering with security, scraping at unreasonable scale, uploading unlawful content, infringing intellectual property, sending spam, reverse engineering except where lawfully permitted, or using the service to harm others.

Customer data and responsibilities

You retain responsibility for information you submit to the service, including customer, employee, production, order, artwork, or business data. You confirm that you have the necessary rights, notices, consents, and lawful bases to provide that data to us for processing through the service.

You should not submit sensitive personal data, regulated health data, payment card numbers, government identification numbers, or other highly sensitive information unless the relevant feature explicitly supports it and appropriate written terms are in place.

Subscriptions, payments, and taxes

Paid features may be offered through subscription plans, one-time purchases, or trials. Prices, billing periods, included features, usage limits, and renewal terms will be shown at checkout or in the relevant order flow. Taxes may be added where required.

Payments may be processed by third-party payment providers. By purchasing a paid service, you authorise the applicable charges and agree to the payment provider terms shown during checkout. Unless otherwise stated, subscriptions renew automatically until cancelled.

You can cancel renewal according to the instructions in the dashboard or by contacting support. Cancellation normally stops future renewal and does not automatically refund amounts already paid, unless required by law or expressly stated in a separate agreement.

Trials, beta access, and waitlist

Trials, beta access, previews, and waitlist invitations may be limited, changed, suspended, or withdrawn. Beta and preview features may be incomplete, unavailable, or changed without notice and should not be relied on for critical production use unless we expressly agree otherwise in writing.

Intellectual property

We and our licensors own the service, website, software, design, trademarks, content, and related intellectual property, except for your data and content. These Terms give you a limited, non-exclusive, non-transferable right to use the service according to these Terms and any plan limits.

You own your content and data. You grant us the rights needed to host, process, transmit, back up, display, and otherwise use that content solely to provide, secure, support, and improve the service, and as otherwise allowed by these Terms and our Privacy Policy.

Third-party services

The service may integrate with third-party services such as payment processors, email providers, authentication providers, analytics tools, anti-spam services, hosting providers, or other integrations. We are not responsible for third-party services, and your use of them may be subject to their own terms and policies.

Service availability and changes

We aim to provide a reliable service, but we do not guarantee uninterrupted or error-free operation. We may maintain, update, improve, suspend, or discontinue parts of the service. Where practical, we will try to give reasonable notice of material changes affecting paid users.

Disclaimers

To the maximum extent permitted by law, the service is provided on an “as is” and “as available” basis. We disclaim warranties that the service will be uninterrupted, error-free, secure, or suitable for a particular purpose. Nothing in these Terms excludes rights that cannot be excluded under applicable consumer or data protection law.

Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, data, or business interruption. For paid services, our total liability for claims relating to the service is limited to the amount you paid for the service in the 12 months before the event giving rise to the claim, unless applicable law requires otherwise.

Indemnity

If you use the service on behalf of a business, you agree to defend and indemnify us against claims, losses, liabilities, damages, costs, and expenses arising from your misuse of the service, breach of these Terms, unlawful data you provide, or violation of third-party rights.

Suspension and termination

You may stop using the service at any time. We may suspend or terminate access if you breach these Terms, fail to pay, create security or legal risk, or if continued provision of the service is no longer commercially or legally practical. After termination, provisions that by their nature should survive will continue to apply.

Changes to these Terms

We may update these Terms from time to time. If changes are material, we will take reasonable steps to notify users where required. Continued use of the service after updated Terms become effective means you accept the updated Terms.

Governing law and disputes

The governing law, venue, and dispute process should be confirmed in a separate written agreement or legal review based on the legal entity operating the service and the markets served. Nothing in these Terms limits mandatory rights or protections that apply in your country of residence.
